To unsubscribe, Click the "UNSUBSCRIBE" button at the bottom of any email or Reply "STOP" to any text message Unsubscribing from one channel (email or SMS) does not automatically unsubscribe you from others. PEXIA Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PEXIA’s services, platform, and software. By subscribing to or using any PEXIA service, you agree to be bound by these Terms.

1. Scope of Services

PEXIA provides AI-powered business automation and marketing infrastructure, including but not limited to:

  • Custom business websites
  • AI reception, messaging, and booking agents
  • CRM access
  • Business phone numbers for calling and texting
  • Lead follow-up systems, remarketing tools, and review generation tools
  • Advertising management and optimization services
  • Strategic consulting and onboarding support

All services are provided as a subscription unless otherwise specified in writing.

2. Subscription Plans

PEXIA offers the following primary subscription plans:

$297/month Plan

Includes:

  • Fully built and hosted business website
  • Access to the PEXIA platform (web and mobile app)
  • Business phone number for calls and texts
  • CRM access
  • Automation workflows
  • Remarketing tools
  • Customer review generation tools

$497/month Plan

Includes:

  • All features from the $297/month plan
  • AI messaging agents
  • Full lead nurturing

$1,497/month Plan

Includes:

  • All features from the $497/month plan
  • Full management and optimization of Meta Ads or Google Local Service Ads
  • Ad spend not included. Client determines budget.

3. Billing, Auto-Renewal, and Commitments

  • All subscription fees are billed in advance of the service period.
  • Subscriptions automatically renew on a monthly basis unless canceled.
  • Clients may choose month-to-month billing or a prepaid 3-month commitment.
  • Prepaid 3-month commitments include a complimentary Google Business Profile optimization valued at $400.
  • Payments are processed securely via Stripe using a valid credit or debit card.

4. Usage-Based Charges (Rebillable Costs)

In addition to subscription fees, clients incur usage-based charges related to communication services and platform usage.

Current Usage Rates (USD$)

Phone Numbers:

  • Local: $1.15/month
  • Toll-Free: $2.15/month

SMS (US/Canada):

  • $0.0079 per segment inbound and outbound

MMS (US/Canada):

  • $0.02 outbound
  • $0.01–$0.02 inbound

Voice Calls:

  • $0.0180 per minute outbound
  • $0.0085–$0.0220 per minute inbound

Number Intelligence Services:

  • $0.005–$0.01 per function

Rates may change based on carrier pricing and platform providers.

5. Wallet System and Auto Top-Up

Clients maintain a digital wallet balance to cover usage-based charges.

When wallet funds fall below a threshold, automatic billing occurs based on the client’s selected auto top-up preference.

Failure to maintain sufficient wallet balance may result in service interruptions.

6. No Refund Policy

All payments made to PEXIA are final and non-refundable, including:

  • Subscription fees
  • Usage-based charges
  • Setup or implementation work

You acknowledge that PEXIA services are custom-built, provisioned immediately, and non-reversible once delivery begins.

7. Chargebacks and Payment Disputes

Chargebacks or payment disputes for services rendered are not permitted.

  • Initiating a chargeback constitutes a material breach of these Terms.
  • PEXIA may submit evidence of contract acceptance, platform access, usage logs, and delivery documentation.
  • Fraudulent chargebacks may result in recovery actions for disputed amounts plus administrative, legal, and collection costs.

8. Delivery and Fulfillment of Services

Services are considered delivered and fulfilled once:

  • The client’s website has been completed and made accessible
  • Platform access, automation systems, and core configurations are enabled

Onboarding assistance and login support are not conditions of fulfillment.

9. Client Responsibilities

Clients agree to:

  • Provide accurate and up-to-date business information
  • Respond promptly to communication requests
  • Use services legally and ethically
  • Maintain valid payment methods
  • Comply with applicable laws and platform usage policies

10. Intellectual Property

All software, systems, prompts, workflows, designs, and platform components remain the exclusive property of PEXIA unless explicitly transferred in writing.

Clients receive a limited, non-transferable license to use deliverables solely within their subscribed service scope.

11. Confidentiality

Both parties agree to protect all non-public, confidential information.

PEXIA may reference a client’s brand or results.

12. Service Availability and Modifications

While PEXIA aims for continuous availability, service interruptions may occur.

PEXIA reserves the right to modify, suspend, or discontinue any service with reasonable notice.

13. Cancellation and Termination

  • Subscriptions may be canceled at any time.
  • Cancellations take effect at the next billing cycle.
  • No refunds are issued for unused time or prepaid terms.
  • PEXIA may terminate services immediately for non-payment, misuse, or illegal activity.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada, and applicable federal laws.

15. Changes to These Terms

PEXIA may update these Terms periodically. Continued use of the services constitutes acceptance of the revised Terms.
